Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MagicTicket (the “Service”), a hosted ticket-management application provided by DigiDom Advanced Technology. By creating an account, accepting an invite, or otherwise using the Service you agree to these Terms. If you are accepting on behalf of a company or other organization, you represent that you have authority to bind that entity to these Terms.

1. Eligibility

You must be at least 16 years old to create an account. The Service is intended for business use; consumer use is permitted but the Service is not designed as a consumer product.

2. Accounts and workspaces

MagicTicket is a multi-tenant application. Each customer organization (a “Workspace”) is administered by one or more workspace admins who control invitations, roles, and the data their Workspace processes. As a workspace admin, you are the data controller for the end-customers and team members you invite into your Workspace; MagicTicket acts as a data processor on your behalf, handling that data only to operate the Service.

You are responsible for keeping account credentials secure, for all activity that occurs under your account, and for ensuring members you invite are authorized to access the data you give them access to.

3. Your content

You and your Workspace members retain all rights to the tickets, messages, attachments, knowledge-base entries, and other content you submit (“Customer Content”). You grant MagicTicket a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, modify, and otherwise process Customer Content solely as necessary to provide the Service to you, including sending Customer Content to subprocessors listed on our subprocessors page.

4. Acceptable use

You will not, and will not permit anyone using your Workspace to:

  • Use the Service to send spam, phishing, malware, or otherwise unlawful content;
  • Attempt to access another Workspace’s data, probe or test the security of the Service, or interfere with its operation;
  • Reverse engineer, decompile, or attempt to extract the source code of the Service except where applicable law prohibits this restriction;
  • Use the Service to violate the privacy, intellectual property, or other rights of any person;
  • Resell, sublicense, or commercially redistribute the Service without our prior written consent;
  • Use the Service to store or process data subject to specialized regulations (such as HIPAA-protected health information or payment-card data) unless we have agreed in writing to support that use case.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

5. AI features

Some features of the Service (collectively, “MagicAI”) process ticket content using third-party AI models, including xAI (Grok). This includes automated replies, suggested drafts, ticket summaries, and the auto-deflection panel on new tickets. AI output may be inaccurate or incomplete; you and your team are responsible for reviewing AI output before relying on it for any decision. 6. Subscriptions, fees, and trials

Paid plans are billed in advance, monthly or annually depending on the plan you select, in U.S. dollars. We offer a 3-day free trial on new Workspaces; no credit card is required to start. At the end of the trial, the Workspace is downgraded to read-only access unless an admin subscribes to a paid plan.

Fees are exclusive of taxes, levies, or duties imposed by taxing authorities, which are your responsibility.

7. Third-party services

The Service integrates with or links to third-party services (TeamViewer downloads, xAI, Stripe, Resend, Twilio, etc.). Your use of those services is governed by their own terms; we are not responsible for their content, practices, or availability. TeamViewer specifically: MagicTicket only links to TeamViewer’s public download page from the ticket interface. We do not observe, record, or otherwise process the content of remote-control sessions.

8. Termination

You may stop using the Service or close your account at any time from Workspace → Manage billing. We may suspend or terminate your access if you materially breach these Terms, fail to pay fees, or use the Service in a way that harms the platform or other users. On termination, Customer Content for the closed Workspace remains available for export for 30 days, after which it is deleted from primary stores; Supabase backups continue to expire on their normal retention schedule.

9. Service changes and beta features

We continuously improve the Service. Some features are labeled “beta” or are otherwise experimental and may be modified or removed at any time. We will not materially decrease functionality of generally-available features without prior notice.

10. Disclaimers

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT MAGICAI OUTPUT WILL BE ACCURATE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EACH PARTY’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE FEES YOU PAID OR OWED IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

12. Indemnification

You will defend, indemnify, and hold harmless MagicTicket from third-party claims arising out of (a) your or your Workspace members’ violation of these Terms, (b) your Customer Content, or (c) your use of the Service in violation of applicable law.

13. Governing law and disputes

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. Before filing a formal dispute, you agree to first contact us via the contact page and attempt to resolve the matter informally. Any unresolved disputes will be brought exclusively in the state or federal courts located in [STATE].

14. Changes to these Terms

We may revise these Terms from time to time. The current revision is identified by the version stamp at the top of this page. When a revision is material, signed-in users will be prompted to re-accept; we may also notify account holders by email. Continued use of the Service after a revision takes effect constitutes acceptance of the new Terms.

15. Miscellaneous

These Terms (together with the Privacy Policy and other linked policies) are the entire agreement between you and MagicTicket regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign these Terms without our prior written consent. No waiver of any term will be deemed a further or continuing waiver of such term or any other term.
